TERMS OF SALE

These Terms of Sale apply to purchases from The Poke Ring through thepokering.com. By placing an order, you agree to these Terms of Sale, our Refund Policy, Privacy Policy, and any product-specific terms shown before checkout.

Nothing in these terms limits any right or remedy that cannot legally be excluded or waived.

ELIGIBILITY AND MINOR PERMISSION

You must provide accurate information and be legally able to enter into a purchase contract.

Anyone under the age of majority where they live must have permission from a parent or legal guardian before creating an account or placing an order. The parent or guardian is responsible for reviewing and approving the purchase.

PRODUCTS, PRICING, AND AVAILABILITY

We try to describe our products, prices, inventory, and promotions accurately. Product images may differ slightly from the delivered product.

Trading-card contents and market values are not guaranteed. We may:

• Correct clear pricing or listing errors.

• Limit purchase quantities.

• Reject suspected fraudulent orders.

• Cancel an order when a product is unavailable.

If we cancel an order, we will provide the refund required by applicable law.

LIVE RIP AND SHIP

Products designated as “Live Rip” are opened during a livestream and are not shipped sealed.

By purchasing a Live Rip product, you:

• Authorize The Poke Ring to open the product during a livestream.

• Understand that trading-card contents are randomized.

• Understand that specific cards, hits, grades, or market values are never guaranteed.

We do not intentionally display private customer contact, payment, billing, or shipping information during a livestream.

Orders may be opened during the next available livestream or another announced stream. Opening times and queue positions may change based on order volume, inventory verification, operational needs, and stream scheduling. A specific opening time is not guaranteed unless we expressly state otherwise.

CARD-FULFILLMENT OPTIONS

When offered, your selected card option controls which cards are included in your shipment:

• Bulk: All cards from the purchased packs are included.

• No Bulk: Hits only are included. Common cards are not included.

These are card-fulfillment choices, not shipping methods. Any difference in price will be displayed before the order is placed.

Your selection on the product page or at checkout controls if it conflicts with a general description elsewhere on the website.

BUNDLES, SHIPPING, AND INSURANCE

When offered, orders may be held and combined into a monthly bundle. Customers must follow the current bundle and shipping instructions displayed at checkout or on our How Rip & Ship Works page.

Shipping and delivery estimates are not guarantees.

Optional shipping insurance is not included in the standard shipping charge. Before monthly bundles are shipped, we may contact customers with an optional insurance price based on the shipment’s declared value, weight, and carrier pricing.

Customers may accept or decline optional insurance. Declining optional insurance does not waive any right that cannot legally be waived.

Customers are responsible for providing a complete and accurate shipping address. Customs duties, taxes, import charges, and destination-country requirements are the customer’s responsibility unless applicable law requires otherwise.

PROMOTIONS, GIVEAWAYS, AND MEMBERSHIPS

Promo codes are subject to their stated conditions, availability, and expiration dates. Unless otherwise stated, discounts cannot be combined or applied retroactively.

Giveaways, wheel spots, memberships, bounties, pack battles, and other promotions may have separate rules announced on our website, livestreams, YouTube channel, Discord server, or other official platforms.

Promotions are void where prohibited. No purchase is necessary where required by law.

PAYMENT AND FRAUD PREVENTION

Payment is due at checkout through the payment methods currently offered.

We may use automated or manual fraud-prevention checks and may request reasonable verification. We may cancel or restrict orders associated with:

• Suspected fraud.

• Unauthorized payment use.

• Promotion or giveaway abuse.

• Chargeback misuse.

• Attempts to avoid stated purchase limits.

CANCELLATIONS, RETURNS, AND ORDER PROBLEMS

Our Refund Policy is incorporated into these Terms of Sale.

Change-of-mind sales are generally final, except where applicable law gives the customer additional rights.

Please contact us promptly about:

• Cancellation requests.

• Incorrect or missing items.

• Damaged or defective products.

• Carrier or delivery problems.

• Packages marked delivered that cannot be located.

• Any other order concern.

Available remedies depend on the circumstances and applicable law.

If we approve a full refund before an order ships, the shipping charge paid for that order will also be refunded.

Return postage may be the customer’s responsibility where the law allows. We will not charge an undisclosed cancellation, processing, or restocking deduction.

INTELLECTUAL PROPERTY AND ACCEPTABLE USE

The Poke Ring name, branding, original graphics, website content, stream assets, photographs, videos, and other original materials are protected by applicable intellectual-property laws.

You may not copy, sell, impersonate, scrape, interfere with, or misuse our website, content, branding, or services except as permitted by law or with our written permission.

SERVICE AVAILABILITY AND LIMITATION OF LIABILITY

We do not guarantee uninterrupted access to our website, livestreams, YouTube channel, payment providers, shipping carriers, or other third-party platforms.

To the fullest extent permitted by law, The Poke Ring is not responsible for indirect, incidental, special, or consequential losses arising from the use of our website, services, or products.

This limitation does not apply where prohibited by law or to liability that cannot legally be limited or excluded.

GOVERNING LAW AND DISPUTES

These terms are governed by the laws of Pennsylvania and applicable United States law, without depriving a consumer of mandatory protections that apply in the consumer’s place of residence.

Before beginning a formal dispute, please contact us and provide a reasonable opportunity to investigate and resolve the issue.

CHANGES AND SEVERABILITY

We may update these Terms of Sale for future purchases. The version displayed when an order is placed will generally apply to that order, subject to applicable law.

If any provision is found unenforceable, the remaining provisions will continue to apply to the extent allowed by law.
